PCNs - exercise of discretion - #4 Brent

Very simple reply from Brent Council, we don't have a policy.

Mr Mustard isn't reassured by the fact that the staff have a BTEC as that can't teach them how Brent Council exercise their discretion, it could have been obtained when they worked for any number of different parking enforcement agents.

The London Councils Code of Practice cannot and does not set Brent Council's policies on the exercise of discretion, Brent Council should do that.

The Statutory Guidance was the document which said Brent Council should have a policy so this is a somewhat circular justification for not having one.

Their own parking policy does not contain the word discretion.

That is to refer to four documents as red herrings to try and put Mr Mustard off the scent.

Simply put, Brent Council do not have a policy and should have one.
