Newham Council are Cheats - #44

 

It is evident from google street view that this is a location where signs get damaged and by the evidence of this motorist removed altogther.

Fairly rourtine cheating by Newham Council. There was not a sign in the bay where the car was parked so the 'traffic warden' (CEO / officer) took a photograph of a sign in a different bay, one which unless you are informed by signage as to the rules may well have different ones.

Newham Council must know by now, this being one of dozens of cases Mr Mustard has written about that cpz signage does not set the restrictions for parking bays but only for unsigned yellow lines.

They removed the car to the pound so the traffic warden cheated, the back office cheated in rejecting perfect representations and in opposing the Appeal to the independent adjudicator who wasn't having any of it.

The end but not of cheating at Newham Council.

The above is an extract from a letter dated 29 September which takes us halfway to the correct situation.

A council cannot use a 'warning notice' (under what legislation?) to prohibit a motorist from parking in a bay which has no signs or unreadable signs due to vandalism.

The motorist can take advantage of free parking if he/she so wishes.

The same motorist has another PCN in the challenge process? Any bets on whether it will be cancelled or not?

Newham Council removed this car to the pound. Google street view is dated but there are lots of bays without signs at this location. If there isn't a sign alongside the bay in which you are parked the rules have not been communicated to the motorist and no PCN should have been issued, let alone the car removed.

Newham Council are penalising innocent motorists instead of catching vandals who damage or remove signs. They need to start dealing with criminal behaviour and stop issuing unlawful penalties.

The motorist did well to produce better evidence than the council. Clear photos from all angles showing the lack of signage is all you need.
